General Products Warranty
Limited Product Warranty
The Limited Product Warranty is limited to the lesser of twelve (12) months or one hundred thousand (100,000) miles from the original date of purchase of the product purchased from us directly (“Limited Warranty Period”). If the product is exchanged, the Limited Product Warranty will relate back to the date of the purchase of the original product, and it is understood that the Limited Warranty Period will not be reset. The product may come with a manufacturer’s warranty which is longer; however, our Limited Product Warranty is limited to the Limited Warranty Period set forth herein. During our Limited Warranty Period, we will replace or refund, at our option, any product we sell to you that fails due to a defect in materials or workmanship under normal use and service after proper installation. This Limited Product Warranty has further limitations as set forth herein.
To exercise our Limited Product Warranty you: (i) will need to return the product along with your original sales receipt to our store; (ii) must be the original purchaser of the product; and (iii) still own the vehicle on which it was installed.
This Limited Product Warranty is not transferrable.
If a refund is requested by you, the refund will only occur if you return the product in the original packaged condition along with the original box and your original sales receipt to our store within forty-five (45) days from the date of purchase.
Loss of Warranty
DISCOUNT DIESEL TRUCK PARTS, INC. is not responsible for failure resulting from owner or operator abuse or neglect, such as, but not limited to: operation without adequate coolant, fuel, or lubricants; over-fueling; over-speeding; lack of maintenance of lubricating, coolant, or air intake systems; improper storage, starting, warm-up, run-in or shut down practices.
DISCOUNT DIESEL TRUCK PARTS, INC. is not responsible for failures resulting from improper repair or installation, for parts that have been altered or for incorporating parts not approved by DISCOUNT DIESEL TRUCK PARTS, INC.
The Limited Product Warranty will be lost for the following reasons: accident; misuse or use for the incorrect application; abuse; modification; contamination from chemicals, salt or other substances not designed for the product; natural disasters; act of god; improper installation; installation of incorrect part; damages caused by other faulty parts; or products under a manufacturer's recall.
In no event will the Limited Product Warranty extend beyond the ninety (90) day period regardless of the installation date.
Owner’s Responsibilities
Owner is responsible for the operation and maintenance of the engine as specified in the APPLICABLE O.E.M. OPERATION AND MAINTENANCE MANUALS. Owner must give notice within (30) days of any suspected failure and before expiration of applicable Limited Product Warranty to be considered warrantable. Owner will provide alleged defective and associated parts for examination by DISCOUNT DIESEL TRUCK PARTS, INC. who further reserves the right to examine any engine subject to a claim under this Limited Product Warranty. Owner is responsible for all costs, including, but not limited to, repairs made to items other than the engine in which the parts are installed, “downtime” expenses and all business costs and losses resulting from a warrantable failure. OWNER MUST GET AUTHORIZATION FROM DISCOUNT DIESEL TRUCK PARTS’S WARRANTY ADMINISTRATOR (ALONG WITH A RETURN MATERIAL AUTHORIZATION FORM) PRIOR TO FILING A WARRANTY CLAIM WITHIN SAID WARRANTY PERIOD.
Limitations
THIS LIMITED PRODUCT WARRANTY EXPRESSLY DOES NOT COVER LABOR COSTS OR INCIDENTAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES INCLUDING BUT NOT LIMITED TO, PHYSICAL INJURIES OR PROPERTY DAMAGE, LOSS OF TIME, LOSS OF USE OF THE VEHICLE, DAMAGES TO ANY OTHER PRODUCT OR VEHICLE OR PROPERTY, INCONVENIENCE, RENTAL VEHICLE CHARGES, TOWING CHARGES OR ACCOMMODATIONS RESULTING FROM A DEFECT IN OR FAILURE OF THE PRODUCT.
THIS LIMITED PRODUCT WARRANTY REPRESENTS THE SOLE AND EXCLUSIVE REMEDY FOR ANY PRODUCT DEFECT OR FAILURE AND THE TOTAL LIABILITY OF DISCOUNT DIESEL TRUCK PARTS, INC. AND ITS SUBSIDIARIES AND AFFILIATES (“DDTP”) FOR ANY PRODUCT IT WARRANTS.
DDTP MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.
WE NEITHER ASSUME NOR AUTHORIZE ANY OTHER PERSONS TO ASSUME FOR US ANY OTHER LIABILITY IN CONNECTION WITH OUR PRODUCTS.
This Limited Product Warranty shall be interpreted, governed, and enforced in accordance with the laws of Florida; all sales are made within the State of Florida.
